How do I get an EHCP for my child?

To get an EHCP, you need to request an Education, Health and Care Needs Assessment (EHCNA) from your Local Authority. You can request this yourself as a parent — you do not need the school to apply. The Local Authority must decide within 6 weeks whether to assess, and the full process should take up to 20 weeks if agreed.
Does my child need an EHCP?

An EHCP may be needed if your child has special educational needs that cannot be met through standard school support (often called SEN Support). If your child is struggling despite support in school, or their needs are complex or long-term, an EHCP may be appropriate.
What can I do if my child is refused an EHCP?

If the Local Authority refuses to assess or issue an EHCP, you have the right to challenge this decision. This usually involves mediation and, if needed, an appeal to the SEND Tribunal. Many parents successfully overturn refusals with the right evidence and support. Many parents choose to seek support at this stage to strengthen their case and improve the chances of a successful appeal.
How long does the EHCP process take?

The EHCP process should take a maximum of 20 weeks from the initial request to a final plan being issued. The Local Authority must decide within 6 weeks whether to assess. Delays can happen, and parents may need support to challenge missed deadlines.
Can I challenge my child’s EHCP?

Yes. If you disagree with your child’s EHCP — including the support, wording, or school placement — you have the right to request changes and, if necessary, appeal to the SEND Tribunal. Many parents choose to seek support at this stage to strengthen their case and improve the chances of a successful appeal.

What should be included in an EHCP?
An EHCP should clearly describe your child’s needs (Section B) and the support required to meet those needs (Section F). This support must be specific, detailed, and legally enforceable — not vague wording such as “access to” or “opportunities for”.
